Visa Details And Requirements

H-1B (specialty occupation)

If you are coming to the U.S. to do a professional job that has already been set up, you will need an H-1B visa. To be eligible, you must have a bachelor’s degree or higher in your desired field.

The USCIS will decide if your job is a specialty occupation and if you have the skills to do it. Your employer must send the DOL your contract terms.

H-1B1 Work Visas Based on Treaties

Chileans and Singaporeans with FTAs can work in the US. Spouses and children of main applicants can be from other countries.

H-1B1 visa applicants must have a job offer from a U.S. employer in their field. Yet, the employer is not required to file Form I-129, Petition for Nonimmigrant Workers. A Notice of Approval, Form I-797, is not required before submitting a visa application.

H-2A (seasonal agricultural workers)

H-2A visas let employers bring in foreign workers for temporary agricultural jobs. H-2A nonimmigrant status is for temporary or seasonal agricultural work in the U.S.

A U.S. employer must fill out Form I-129, Petition for Nonimmigrant Worker, on your behalf.

H-2B visa (skilled and unskilled workers)

This visa needed if you want to come to the U.S. to work a temporary or seasonal job for which there is a shortage of workers. 

Your employer needs a Labor Department certificate stating no qualified U.S. workers.

H-3 (trainee)

You need an H-3 visa to train for up to two years in any field other than graduate education or training. Pay can given for training, and “hands-on” work allowed. 

Training can’t help you find work, and you can’t get it in your home country.

H-4 (dependents)

Your spouse or unmarried children under 21 can get an H-4 visa if you have a valid H visa.

But, your spouse or children cannot work while in the United States.

L-1 (intra-company transferees)

If you work for a foreign company and are moving to the U.S., you need an L-1 visa. The international company can be from the United States or from another country. To get an L-1 visa, you must be a manager, executive, or have specialized knowledge. 

You must assigned to one of these positions in a U.S. company, but it doesn’t have to be the same one. Three years of international work required before applying for U.S. residency.

USCIS must first approve a “blanket” or individual petition from your U.S. company or affiliate.

L-2 (dependents)

Your spouse or unmarried children under 21 can apply if you hold a valid L visa. Because the law has recently changed, your spouse may be able to apply for work authorization. 

Your spouse must come to the U.S. on his or her own L-2 visa and then send USCIS a filled-out Form I-765 and an application fee. Your kids are not allowed to work in the United States by law.

O

Class O visas are for people with extraordinary skills in the sciences, arts, education, business, sports, or filmmaking, and essential staff.

P (artists, entertainers)

Class P visas are for paid athletes, entertainers, artists, and important support staff. P visa holders pay US Visa income taxes.

Q (cultural exchange)

For a cultural exchange program that offers training, work, and the chance to share your home country’s history, culture, and traditions, you’ll need a Q visa.

The sponsor of the program must file a petition on your behalf, and USCIS must approve the petition.

When to Apply

H, L, O, P, or Q visas can processed 90 days before your I-797 start date.

Federal rules say you can only use the visa ten days before the start of your I-797’s approved status period.

Things that apply

If you want an H, L, O, P, or Q visa, you must send in the following:

  • Nonimmigrant Visa Electronic Application Form (DS-160). Go to the DS-160 website to find out more about it.
  • Passport valid for U.S. travel with at least six months remaining. If many people are on your passport, each visa applicant must have a valid passport.
  • One (1) recent 2″x2″ (5cmx5cm) photograph. This website explains how the photo needs to formatted.
  • A receipt showing you paid US$190 in local currency for a nonimmigrant visa. This fee is not refundable. On this website, you can find out more about how to pay this fee. Depending on your country of origin, you may have to pay an extra fee for visa reciprocity if you get one.   • L-1 applicants on blanket petitions must pay a fee to prevent fraud.
  • On the back of your approved I-129 petition, you can find the number of receipts. No hard copies of the I-797 need to brought to the interview.

How to Apply for Us Work Permit Visa

Step 1

Fill out the electronic application for a nonimmigrant visa (DS-160).

Step 2

Pay the fee for getting a visa.

Step 3

Use this website to make an appointment. You will need the following information to set up your appointment:

  • Your passport’s number.

  • The ten-digit barcode number on the back of your DS-160 confirmation page.

Step 4

  • Original copies of your spouse’s marriage certificate and/or unmarried children’s birth certificates.
  • Your employer’s letter confirming that you will still be working for them.
  • Provide pay stubs and federal tax returns (IRS Form 1040 and W-2s) for all years your spouse worked in the U.S. on an H-1B visa.

Make sure you don’t bring any documents in sealed envelopes to your interview at the Embassy.
